Terms of Service for Awesomize.ai

1. Acceptance of Terms

By accessing and using Awesomize.ai ("the Site"), you agree to these Terms of Service. If you do not agree, discontinue use immediately.

2. Permitted Use

The Site is for personal, non-commercial use. You agree to use it lawfully and ethically.

You must not engage in illegal, abusive, harmful, obscene, defamatory, or harassing behavior; attempt unauthorized access; disrupt the Site; advertise without permission; or reverse-engineer the Site.

3. Nature of the Site

Awesomize.ai is a directory and curator for proprietary ChatGPT apps. Apps run within OpenAI's ChatGPT environment; the Site does not host the apps.

Using any listed app occurs inside ChatGPT and is governed by OpenAI's terms and the specific app's terms.

4. Scope of These Terms

These Terms cover your use of the Site only. When you use ChatGPT or any app, you are also bound by OpenAI's terms, the app's terms, and applicable law. Access to apps is not guaranteed and may be subject to subscriptions or controls.

5. Third-Party Services

We curate and list apps but do not operate or control the apps or the ChatGPT environment. We are not responsible for app functionality, accuracy of descriptions, data loss, or any harm arising from ChatGPT or the apps.

6. MCP Server URLs

If provided, MCP server URLs are offered "as-is" without guarantees. We are not responsible for changes, downtime, or data transmitted through MCP servers.

7. Intellectual Property

All Site content is owned by Awesomize.ai or its providers and is protected by copyright. You may not copy, distribute, modify, or use content without written permission, except for personal, non-commercial viewing.

8. Disclaimer

The Site is provided "as-is" and "as-available." We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee error-free or uninterrupted service.

9. Limitation of Liability

To the maximum extent permitted by law, Awesomize.ai is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or apps. Our total liability shall not exceed amounts you paid us (if any).

10. Indemnification

You agree to indemnify and hold Awesomize.ai harmless from claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Site or apps, your breach of these Terms, or your violation of third-party rights.

11. Termination

We may terminate your access at any time, with or without notice. Upon termination, your right to use the Site ceases immediately.

12. Changes to Terms

We may update these Terms and will post updates here with a revised effective date. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by applicable law without regard to conflict-of-law principles.

14. Dispute Resolution

Disputes shall first be resolved through good-faith negotiation. If unresolved, disputes may proceed to binding arbitration or litigation as permitted by law.

15. Severability

If any provision is found unenforceable, it will be modified to the minimum extent necessary, and the remainder will stay in effect.

17. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement regarding your use of the Site, superseding prior agreements.

18. Awesomize Mobile Application (iOS)

These additional terms apply specifically to the Awesomize mobile application (the "App") published on the Apple App Store and operated by Vidline. Where these terms conflict with the general Terms above, these terms control for use of the App.

18.1 Description of the App. The App lets you generate images and videos using artificial intelligence ("AI-Generated Content"), browse inspiration, and manage your account and subscriptions. The App is a standalone product and is not affiliated with, endorsed by, or sponsored by OpenAI or Apple.

18.2 User-Generated and AI-Generated Content; Zero Tolerance for Objectionable Content. You are solely responsible for the prompts you submit and the content you generate, upload, save, or share through the App ("Your Content"). There is zero tolerance for objectionable, abusive, or illegal content or behavior. You agree that you will not create, upload, or distribute content that is unlawful, hateful, harassing, sexually explicit involving minors, violent, defamatory, infringing, or that violates the rights or privacy of others.

To keep the community safe, we:

  • apply automated and manual content filtering / moderation to content created and shared in the App, and reject or remove content that violates these terms;
  • provide an in-app "Report" mechanism (and [email protected]) so you can flag objectionable content or abusive users;
  • review reports and act within 24 hours, removing offending content and, where appropriate, suspending or permanently banning the user who provided it;
  • allow you to block other users so you no longer see their content or receive contact from them.

We may remove any content and terminate any account that violates these terms, at our discretion and without prior notice.

18.3 Auto-Renewable Subscriptions and Credits (Apple In-App Purchase). The App offers the following purchases, processed through Apple In-App Purchase and billed to your Apple ID:

  • Auto-renewable subscriptions — *Basic* and *Plus* plans, each available with a monthly or yearly billing period. Each plan provides the in-app benefits and generation allowance described at the point of purchase.
  • Credits — a one-time, consumable purchase used to generate additional content. Credits do not auto-renew and are consumed as you use them.

The exact title, duration, benefits, and price of each subscription and of Credits are shown in the App and on the App Store at the point of purchase. By subscribing you agree that:

  • Payment is charged to your Apple ID account upon confirmation of purchase.
  • A subscription automatically renews at the then-current price for the same period unless you turn off auto-renew at least 24 hours before the end of the current period.
  • Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel your subscription, and turn off auto-renewal, in your App Store account settings (Settings → your name → Subscriptions) at any time. Cancelling stops the next renewal; the current paid period is not refunded and remains active until it expires.
  • If a free trial is offered, any unused portion of a free trial is forfeited when you purchase a subscription to that content, where applicable.

18.4 Apple Standard EULA. Unless you have signed a separate agreement with us, your license to use the App is also governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Apple is not responsible for the App or its content and has no obligation to furnish maintenance or support for it.

18.5 Account and Account Deletion. Some features require an account (e.g. sign-in with Google or Apple). You may delete your account and associated data at any time from within the App (Profile / Settings → Delete Account). Deleting your account removes your profile and associated personal data as described in the Privacy Policy.

18.6 Disclaimer for AI-Generated Content. AI-Generated Content may be inaccurate, unexpected, or offensive, and is provided "as-is." You are responsible for reviewing and for how you use any content you generate, and for ensuring your use complies with applicable law and any third-party rights.

18.7 Eligibility. You must be at least 13 years old (or the minimum age of digital consent in your country, e.g. 16 in parts of the EEA) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian.

18.8 Third-Party AI Processing; Consent and Rights to Your Content. The App's core features generate images and videos using third-party AI service providers. To provide these features, the text prompts you enter and the photos, images, or videos you upload (which may include images of people, such as faces) are transmitted to and processed by those third-party AI providers solely to generate the content you request, as further described in our Privacy Policy. Before any such data is sent, the App discloses what data is sent and to whom and asks for your consent; your data is sent only after you agree. You represent and warrant that you own or have all rights, licenses, and permissions necessary to submit the content you upload, and that you will not upload images of other people without their consent. Our collection, use, and sharing of your data — including the third-party AI providers that receive it — are described in the Privacy Policy.
